2. The Service
Giftafi provides custom song writing and music production services. We use a blend of professional audio engineering and advanced vocal synthesis technology (“Smart Production”) to create personalized songs based on the stories, memories, and details you provide.
3. Ordering & Payment
- Order Acceptance: Your order is an offer to purchase. A contract is formed only when we send you an email confirming that production has started.
- Pricing: Prices are displayed in GBP (£) and include VAT where applicable. We reserve the right to change pricing at any time without notice.
- Payment: Payment must be made in full at the time of ordering via our secure payment processors (Stripe/PayPal).
4. User Content & Copyright
- Your Responsibility: You are responsible for the stories, lyrics, and images you submit to us. You must not submit content that is offensive, hate speech, or infringes on a third party’s copyright (e.g., do not paste lyrics from a famous Taylor Swift song).
- License to Us: By submitting your story/lyrics, you grant Giftafi a worldwide, royalty-free license to use, modify, and adapt that content for the purpose of creating your song.
5. Intellectual Property Rights (Who Owns the Song?)
- Your License: Upon delivery, Giftafi grants you a perpetual, non-exclusive, worldwide license to use the song for personal, non-commercial use.
- What You CAN Do: You can share it on social media, play it at events (weddings/parties), upload it to Spotify/Apple Music (via our distribution partners), and share the file with friends and family.
- What You CANNOT Do: You may not resell the song, license it to third parties for commercials/TV, or claim to be the original composer of the underlying musical composition.
- Ownership: Giftafi retains the copyright to the underlying musical composition and recording technology.
6. Digital Delivery
- Format: Songs are delivered as high-quality MP3 files via email.
- Timeline: We aim to deliver standard orders within 48 hours. However, technical delays can occur. If delivery is delayed significantly, our liability is limited to a refund of any “Priority/Express” fees paid.
- Non-Delivery: If you do not receive your song, please check your spam folder before contacting support.
7. Refund Policy
Our Refund Policy is a separate document but forms part of these Terms. Because our products are custom-made digital files, we do not offer “change of mind” refunds once production has begun. Please refer to our Refund Policy page for full details on cancellations and revisions.
8. Limitation of Liability
To the fullest extent permitted by law, Giftafi shall not be liable for any indirect, incidental, or consequential damages arising from the use of our products. Our total liability for any claim shall not exceed the purchase price paid by you for the product.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
